1. General provisions

1.1. These terms and conditions for the purchase and sale of goods (hereinafter the “Terms”) are a legally binding document for the parties, setting out the rights and obligations of the Buyer and the Seller, the conditions for purchasing and paying for goods, the procedure for delivery and return of goods, the liability of the parties, and other provisions related to the purchase and sale of goods in the online store www.pcplace.lt.

1.2. The terms of the PCPLACE.LT online store (hereinafter the “Store”) apply when the Customer places an order to purchase goods online at www.pcplace.lt. MB “Ekokompiuteriai”, Pramonės pr. 16, Kaunas LT-51186, Lithuania, tel.: +370 604 02514, email: info@pctaisymaskaune.lt.

1.3. MB “Ekokompiuteriai” has the right to amend the Store’s Terms. When the Customer shops in the Store, including order fulfilment, the Terms in force at the moment the order is placed (indicated with the order) apply.

1.4. The online store www.pcplace.lt is open to all legal entities and natural persons of legal age whose legal capacity has not been restricted by court order, as well as minors between 14 and 18 years of age with the consent of their parents or guardians, except where they independently dispose of their own income.

1.5. By placing an order, the Buyer confirms that they agree to these purchase terms and, under clause 1.4, are entitled to purchase goods in the online store.

1.6. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer, having assembled a shopping cart in the online store, indicated the delivery address, chosen a payment method and read the Seller’s terms, clicks the “Place order” button.

1.7. The Buyer and the Seller agree that after the Buyer has placed an order and the Seller has confirmed it, the price of the goods may change due to objective factors affecting the price, such as an increase in the cost of the goods, a technical error in information systems, or additional costs related to selling the goods to the Buyer (Art. 6.313(7) of the Civil Code of the Republic of Lithuania). If the Buyer does not agree to purchase the goods at the new price, either Party may, having notified the other Party, terminate the purchase contract. The Parties agree that losses related to the termination of the contract under this clause shall not be compensated.

1.8. By confirming these Terms, the Buyer agrees that purchase documents — invoices, which also serve as warranty certificates for the goods — will be provided electronically to the email address indicated in the Buyer’s registration form. Invoices in the above form are provided to the Buyer no later than the moment the goods are handed over. The invoice indicates the selected goods, their quantity, discounts granted, the final price of the goods including all taxes, delivery charges, and other data required under accounting legislation.

2. Protection of personal data

2.1. When ordering goods in the online store www.pcplace.lt, the Buyer must provide the data requested during registration.

2.2. The Buyer is responsible for providing correct data during registration.

2.3. By placing an order, the Buyer agrees that their personal data will be processed for the purposes of order management, business analysis and direct marketing. The Buyer also agrees that informational messages necessary for fulfilling the order will be sent to the email address or phone number provided by the Buyer.

2.4. By registering in the online store and ordering goods, the Buyer undertakes to keep their login details safe and not disclose them to anyone.

2.5. The Seller undertakes not to disclose the Buyer’s personal data to third parties, except in cases provided for by the legislation of the Republic of Lithuania.

3. Buyer’s rights and obligations

3.1. The Buyer has the right to purchase goods in the online store www.pcplace.lt in accordance with these Terms and the other information sections of the online store.

3.2. The Buyer has the right to withdraw from the purchase contract by notifying the Seller by email or phone.

3.3. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.

3.4. If the Buyer’s data provided in the registration form changes, the Buyer must update it without delay.

3.5. The Buyer undertakes not to disclose their login details to third parties. If the login details are lost, the Buyer must immediately inform the Seller.

3.6. By placing an order in the online store www.pcplace.lt, the Buyer agrees to these purchase Terms, undertakes to comply with them and not to violate the legislation of the Republic of Lithuania.

4. Seller’s rights and obligations

4.1. The Seller undertakes to provide all conditions for the Buyer to properly use the services of the online store www.pcplace.lt.

4.2. If the Buyer attempts to undermine the stability or security of the online store or violates their obligations, the Seller has the right to immediately and without warning restrict, suspend or terminate the Buyer’s access to the online store.

4.3. The Seller undertakes to respect the Buyer’s right to privacy regarding the personal information provided in the registration form and not to transfer it to third parties.

4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address indicated by the Buyer.

5. Ordering goods, prices, payment procedure, deadlines

5.1. The Buyer can shop in the online store 7 days a week, 24 hours a day. Orders by phone or email are accepted during the working hours indicated in the contacts section of the website.

5.2. The contract is considered effective when the Buyer clicks the “Place order” button and the Seller, having received the order, confirms it by sending a confirmation email to the address indicated by the Buyer or by other agreed means.

5.3. All prices in the online store are indicated in euros.

5.4. Payment can be made using the online banking services of Swedbank, SEB, Luminor, Citadele and Šiaulių bankas. Payments are possible in euros. Payments are processed via the MakeCommerce.lt payment platform. The Buyer transfers the money to the current accounts of MB Ekokompiuteriai. In this case, responsibility for data security lies with the respective bank in whose online banking system the transactions take place. Alternatively, payment can be made by bank transfer: the Buyer prints out the order, goes to the nearest bank branch and transfers the money to the online store’s bank account.

5.5. The Customer undertakes to pay for the ordered goods without delay; otherwise, they lose the right to make claims regarding breach of delivery deadlines, since the parcel is only assembled after MB “Ekokompiuteriai” has received payment for the goods.

5.6. If the Buyer fails to make the payment or transfers only part of the money, the order is cancelled. If money has been transferred to the current accounts of MB “Ekokompiuteriai”, it is refunded to the buyer within 7 business days.

6. Delivery of goods

6.1. When choosing the delivery service during the order, the Buyer undertakes to indicate the exact place of delivery.

6.2. The Buyer undertakes to accept the goods personally. If the Buyer cannot accept the goods personally and the goods have been delivered to the indicated address, the Buyer has no right to make claims against the Seller regarding delivery to the wrong recipient.

6.3. The goods are delivered by the Seller’s authorised representative (courier), or the Buyer collects them at the nearest post office. The Buyer may also collect the goods in Kaunas, Pramonės pr. 16, having informed the Seller in advance by phone or email.

6.4. The Seller may apply delivery discounts if the Buyer exceeds a specified order amount.

6.5. The Seller delivers the goods to the Buyer within the deadlines indicated in the product descriptions. In exceptional cases, delivery may be delayed due to unforeseen circumstances beyond the Seller’s control. In such cases, the Seller undertakes to contact the Buyer immediately and agree on the delivery conditions.

6.6. In all cases, the Seller is released from liability for breach of delivery deadlines if the goods are not delivered to the Buyer, or are delivered late, due to the Buyer’s fault or circumstances beyond the Seller’s control.

6.7. The Buyer must immediately inform the Seller if the parcel is delivered in a crumpled or otherwise damaged package, if the parcel contains goods that were not ordered or an incorrect quantity, or if the goods are incomplete.

6.8. If the Buyer notices damage to the package or the goods upon delivery, they must inform the Seller within 24 hours of receiving the goods.

6.9. If the Buyer receives goods of inadequate quality or defective goods, the Seller provides free shipping in both directions within 2 weeks from the date of receipt of the goods. After the 2-week period from the date of receipt, the Buyer delivers the goods under warranty at their own expense to the collection point in Kaunas, Pramonės pr. 16, PM Urmas, western gallery, unit 4, or may use the paid delivery service offered by the Seller.

7. Product quality and warranty

7.1. The details of all goods sold in the online store www.pcplace.lt are indicated in the product description accompanying each product.

7.2. The Seller is not liable if the colour, shape or other parameters of the goods in the store do not correspond to the actual size, shape or colour of the goods due to the characteristics of the display device used by the Buyer.

7.3. The Seller may provide a different quality warranty for individual types of goods; its specific term and other conditions are indicated in the product description. In all other cases, the goods are covered by the warranty provided for in the relevant legislation.

8. Return and exchange of goods

8.1. Exchange and return of goods are only possible if the goods to be exchanged or returned meet the following requirements:

a) the goods were of inadequate quality; b) the goods have not been used; c) the goods have not been damaged; d) the consumer properties of the goods have been preserved; e) the goods have not lost their commercial appearance; f) the goods were not purchased in a physical store.

The Seller is not obliged to satisfy the consumer’s request to exchange or return goods purchased in a physical store that fall under Point 17 of the Retail Trade Rules of the Republic of Lithuania.

9. Marketing and information

9.1. The Seller may organise various promotions and offers in the online store www.pcplace.lt.

9.2. The Seller has the right to unilaterally, without separate notice, change the conditions of promotions or cancel them. Any change or cancellation of the conditions and procedure of promotions is effective from the moment of the change or cancellation.

9.3. The Seller sends all notices via the means of contact indicated in the Buyer’s registration form.

9.4. The Buyer sends all notices and questions via the phone numbers and email addresses indicated in the “Contacts” section of the Seller’s online store.

9.5. The Seller is not liable if the Buyer does not receive informational or confirmation messages due to internet connection failures, disruptions in the networks of email service providers, or incorrectly provided data by the Buyer.

10. Final provisions

10.1. These purchase Terms have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.

10.2. All disagreements arising from the implementation of these Terms shall be resolved through negotiations. If no agreement is reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.

10.4. The contract is concluded and performed, and all communication between the Customer and MB “Ekokompiuteriai” takes place, in the official language of the Republic of Lithuania.
